内容記述 Prior to the Mahanoy decision, the doctrine of “in loco parentis” was adopted in public schools as a basis for restricting students' freedom of expression, allowing teachers to regulate speech on school grounds on behalf of parents. The same doctrine was applied in the case of Mahanoy. The Mahanoy decision revealed a difference of opinion between Justice Alito, who wrote the concurring opinion, and Justice Thomas, who wrote the dissenting opinion, regarding this doctrine.
By the way, if this “in loco parentis” doctrine were applied to school education, teachers would be substituting for parents in educating their children. If this is the case, then if parents use corporal punishment on their children at home as part of their parenting, it may be acceptable for teachers, who are entrusted by parents to educate their children, to use corporal punishment on their children as well. In fact, in the U.S., teachers are considered to be able to exercise the authority to inflict corporal punishment on children unless the state government or school board explicitly prohibits it, and in the first case in which the “in loco parentis” doctrine was applied and decided, the court held that teachers are substitutes for parents and are given the same authority as parents. On the other hand, this “in loco parentis” doctorine is not applied to children. In fact, in the U.S., teachers are considered to be able to exercise the authority to inflict corporal punishment on children unless the state government or school board explicitly prohibits it, and in the first case in which the “in loco parentis” doctrine was applied and decided, the court held that teachers are substitutes for parents and are given the same authority as parents. On the other hand, this “in loco parentis” doctorine is not applied to children. On the other hand, this doctrine has also been applied in cases in which the constitutionality of personal belongings and body searches of students in public schools was challenged. This paper reviews the development of the “in loco parentis” doctrine in the U.S. Supreme Court's decision on the constitutionality of searches of public school students' personal belongings, examines how the doctrine is applied in school education, and discusses the U.S. Supreme Court's views on the guarantee of public school students' constitutional rights. The paper will also clarify what the U.S. Supreme Court has said about the constitutional rights of students in public schools.
