| 内容記述 | After examining American and Japanese academic theories and precedents, it was concluded that "misleading" commercial speech causes the harm of invading the freedom of the recipient of the speech, and therefore the government's interests gained from regulation typically outweigh the interests invaded, and therefore can be placed outside the scope of protection of freedom of expression. In the Central Hudson decision, which explicitly stated that misleading commercial speech falls outside the scope of protection under U.S. case law, one of the two decisions cited in that section was the Ohralik decision, which provided a more detailed rationale. The Ohralik decision understood the interests protected by regulations on misleading commercial speech to include not only the freedom of decision-making of the recipient of the expression but also the mental peace (privacy) of the recipient, which is an even earlier stage in the process. However, this was because the Ohralik case involved a situation where the regulation sought to prevent face-to-face solicitation by lawyers targeting laypeople, which was akin to a captive audience, and thus does not apply to misleading commercial speech in general. The proposition that misleading commercial speech falls outside the scope of protection under the First Amendment, as stated in the first prong of Central Hudson, can be justified under this understanding. The definition of misleading commercial speech is, by its nature as a regulation of certain types of expression, inevitably broad and abstract to some extent, and the rest is a matter of application. It is difficult to determine whether specific commercial speech (such as advertisements or solicitations) is misleading, and the burden of proof for misleadingness becomes an issue. In the United States, since commercial speech is viewed as freedom of expression, it is considered that the government bears the burden of proving misleadingness. However, as pointed out in the dissenting opinion in the Sorrell case, commercial speech is essentially a regulation of economic freedom, and the burden of proving misleadingness can be shifted from the government to the regulated party. In Japan, where there are no precedents explicitly stating that commercial speech falls within the scope of freedom of expression, it is entirely possible to view this as a matter of regulating economic freedom, and it seems easier than in the United States to accept shifting the burden of proof to the regulated party. The implications derived from the examination of government interests as a reason for excluding misleading commercial speech from the scope of protection of freedom of expression suggest that political speech, when misleading, may also fall outside the scope of protection of freedom of expression, as it infringes upon important decisions such as whom to vote for when exercising the right to vote. |
