| 内容記述 | Every system of law must embody elements of certainty, stability and predictability on the one hand, and elements of flexibility, fairness and justice in the individual case on the other. It is a peculiarity of the English common law tradition that these two often competing sets of values were ‘institutionalized’ in the two systems of law and equity. The present paper examines the historical and doctrinal origins and development of equity in the English common law tradition, assesses its relationship with the common law and comments on its function in contemporary legal practice. Special attention is paid to the role of the Chancellor and Chancery Court and the administrative fusion of law and equity and its implications. In the final part of the paper the main equitable principles and remedies are considered and reviewed. | |||||||
