Although these guidelines outline support for death with dignity, legal provisions for both euthanasia and death with dignity have not yet been established. With the recent rapid aging phenomenon and increase in the number of deaths per year, the decision is currently left to the medical field, but is there no need for legislation? This study considers the factors that have prevented progress in the debate on legislation, traces changes in people’s attitudes toward end-of-life care, and considers the future legal provisions for euthanasia and death with dignity. The Tokai University Euthanasia Case was the first trial in which a doctor was the defendant, and attracted a great deal of social attention. The ruling specifies four requirements that allow active euthanasia. These four requirements have substantial legal effect as a positive euthanasia law, and are thought to have had a major impact on the way the Japanese think about euthanasia and death with dignity. Among lawyers, the four requirements are difficult to meet in the current age of advanced palliative care and are considered to have “effectively sealed off euthanasia,” which became an opportunity to shift the discussion from euthanasia to death with dignity. Since the Tokai University ruling, guidelines for death with dignity have been established, and palliative care has developed and become widely known. However, as the public opinion survey shows, awareness of Advance Directives and Advance Care Planning is low, and there are few voices calling for their legalization. The author does not favor immediate legalization. Rather, I think it is more realistic to obtain good informed consent based on the application of guidelines in the medical field and to find common ground through discussion. I would like to raise the following three points as future issues: (1) It is thought that the social security system should be improved to support the care environment so that patients feel that “it is good to be alive.” (2) There is a need for continued discussion on euthanasia and dignified death among the public, medical professionals, lawyers, ethicists, and others, and for a social consensus to be formed. To this end, there is a need for opportunities for free discussion and the exchange of opinions about life and death.
