Two different versions of the character theory are examined and compared: the traditional character theory and the utilitarian motivational theory of responsibility. Following a brief overview of the distinction between justification and excuse in common law jurisprudence, the two versions of the character theory are discussed and their implications are highlighted. The essay concludes that the traditional character theory, with its emphasis on moral blameworthiness, offers a better basis for understanding the nature of criminal responsibility in relation to offences which also constitute moral wrongs. The utilitarian motivational theory, on the other hand, may be given priority when considering the question of responsibility in relation to offences in which the element of moral blame is absent, minimal or questionable.","subitem_description_language":"en"}]},"item_1617186643794":{"attribute_name":"Publisher","attribute_value_mlt":[{"subitem_publisher":"広島大学法学会","subitem_publisher_language":"ja"},{"subitem_publisher":"THE SOCIETY OF LAW OF HIROSHIMA UNIVERSITY","subitem_publisher_language":"en"}]},"item_1617186702042":{"attribute_name":"Language","attribute_value_mlt":[{"subitem_language":"eng"}]},"item_1617186819068":{"attribute_name":"identifier_registration","attribute_value_mlt":[{"subitem_identifier_reg_text":"10.15027/55799","subitem_identifier_reg_type":"JaLC"}]},"item_1617187024783":{"attribute_name":"開始ページ","attribute_value_mlt":[{"subitem_start_page":"108"}]},"item_1617187056579":{"attribute_name":"bibliographic_information","attribute_value_mlt":[{"bibliographicIssueDates":{"bibliographicIssueDate":"2024-10-31","bibliographicIssueDateType":"Issued"},"bibliographicIssueNumber":"2","bibliographicNumberOfPages":"24","bibliographicPageEnd":"85","bibliographicPageStart":"108","bibliographicVolumeNumber":"48","bibliographic_titles":[{"bibliographic_title":"廣島法學","bibliographic_titleLang":"ja"},{"bibliographic_title":"The Hiroshima Law Journal","bibliographic_titleLang":"en"}]}]},"item_1617258105262":{"attribute_name":"item_1617258105262","attribute_value_mlt":[{"resourcetype":"departmental bulletin paper","resourceuri":"http://purl.org/coar/resource_type/c_6501"}]},"item_1617265215918":{"attribute_name":"出版タイプ","attribute_value_mlt":[{"subitem_version_resource":"http://purl.org/coar/version/c_970fb48d4fbd8a85","subitem_version_type":"VoR"}]},"item_1617605131499":{"attribute_name":"File","attribute_type":"file","attribute_value_mlt":[{"accessrole":"open_access","date":[{"dateType":"Available","dateValue":"2024-11-01"}],"displaytype":"simple","filename":"HLJ_48-2_108.pdf","filesize":[{"value":"1.0 MB"}],"mimetype":"application/pdf","url":{"objectType":"fulltext","url":"https://hiroshima.repo.nii.ac.jp/record/2035847/files/HLJ_48-2_108.pdf"},"version_id":"81d4a2f1-74d8-4e09-a045-4882e5f6363d"}]},"item_1617620223087":{"attribute_name":"Heading","attribute_value_mlt":[{"subitem_heading_banner_headline":"論説","subitem_heading_language":"ja"},{"subitem_heading_banner_headline":"Articles","subitem_heading_language":"en"}]},"item_1732771732025":{"attribute_name":"旧ID","attribute_value":"55799"},"item_title":"Character Judgments, Criminal Responsibility, and the Role of Excuses","item_type_id":"40003","owner":"41","path":["1739272046077"],"pubdate":{"attribute_name":"PubDate","attribute_value":"2024-11-01"},"publish_date":"2024-11-01","publish_status":"0","recid":"2035847","relation_version_is_last":true,"title":["Character Judgments, Criminal Responsibility, and the Role of Excuses"],"weko_creator_id":"41","weko_shared_id":-1},"updated":"2025-03-03T09:04:53.792584+00:00"}
